Hi!!

I am preparing grren card aplication with EB2-NIW.

I have question about I485, Part2, Application type.

If my I140 is pending, which type do I (principal applicatn) and my wife (spouse) have to check?

Some people said that I can check "a" and my wife can check "b".

Other people said that I can check "h" with "EB2 NIW" and my wife can also check "h" with "filing concurren
tly with applicant's spouse I-485".

Could you let me know which is right?

Hi

I have valid AP until Oct 16, 2008. I am going out of country between 1st Aug - 31 Aug.

I read that upon return, I will be paroled for validity with 1 year from that date.. i.e 31 Aug, 2009.

Does that mean I will not need AP renewal until 31 Aug, 2009 and I can re-enter US until that date without having to renew AP.?

Although you receive 1 yr parole but you still need AP renewal before the current one expires (Oct 16th in your case). I think that the parole stamp on I-94 does not allow reentry into US.

And what is IV's stand on bringing this issue up to the concerned parties? Nothing - nada - nilch. IV's simply doesn't care even if USCIS wastes another 50,000 EB visas this year. As the article suggests 50,000 is the typical annual wastage of EB visas by USCIS (600,000 in 12 years = 50,000/year).

I paper filed my EAD at NSC last month. RD was 23rd Sept & ND was 2nd Oct.

Looks like yours is a longer delay. Not sure what can be done here. Please keep checking to see if check's are cleared.

No one can guarantee you what you will be asked for. Take everything that you normally need. Legally company MUST give you pay stubs in some form (electronic or paper) if they have paid you. What is the reason for not generating pay stubs if you have worked there after I-797 approval notice or even just after filing? Visa stamp on passport is not required.

Hello,
I'm outside US with AP (expiring in about a month). My GC has been approved this June.
My GC employer has run out of work. He is likely to get work later.
My options are:
a) Stay outside US and look for project. On getting confirmed work, enter US to join employer.
b) Enter US, look for project. On getting confirmed work, join employer.

Getting employed by GC sponsor employer with, either option could take few months.

While entering US, I will NOT have EVL(employment letter), only AP & I485 Approval Notice.
Which is safer option (a or b) for US entry ?
What questions can be asked at POE ? What should I say if asked about employer ?
Can GC be revoked at POE?

Which is safer option (a or b) for GC renewal, citizenship ?

I will be filing my 485 due to the current changes.
I am getting married in December 2007.

1. I am goin to file for my spouse at that time. Is it necessary that the dates should be current in order to file this amendement?

2. I understand that one can file amendment before or within 180 days of acceptance of 485. is this correct ?

3. Is there anyway to know that I am nearing my acceptance of 485?

The first status is that USCIS has approved your EAD and ordered for a card. The second status means that they mailed you the card. You should get the card in next 5 business days.

Your 485/140 maybe processed by Nebraska/Texas Service centers.

I think your employer should cooperate with you by not withdrawing your I-140.


Are you sure that if the employer is not revoking 140, (but they will cancel h1b ) i can join some other employer after receiving EAD but 485 < 180 days

HI All,

Please help me to sort out this difficult query.

Company 'X' holds my H1 Visa and i got an offer from comapny 'Y'
So i can easily xfer my H1 to company 'Y'

But i am expecting a better offer from company 'Z' in couple of days probably 2-3 weeks.It can be also the scenerio tht they may offer me in a day or two when my H1 xfer is already in process from company 'X' to 'Y'

In that case when can i xfer my H1 to company Z?

The worst solution is to get my Visa xfer to company 'Y' and after a month or so get it xfered to 'Z'. Is that possible and allowed to xfer it so quickly?

Hi everyone,

I got my labor approved under perm on Sept 11th however I have not filed for I140 as yet. This is because of employer making n reasons to file the same. Anyways, if the 45 day rule comes into play - does my labor get cancelled as it has been more than 45 days since it has been approved or does the 45 day period start after April 26th. How many of you think this rule will come out. I hope it does. That way employers will have no choice but to file I 140. A lot of employers now adays are stalling filing the same since they fear the employee will move. Am I the only one facing the same problem or are there others as well?

Hello, I'm Hyoung and I'm graduate student at Purdue University.

I handed in my paperworks to extend my I-20 before more than 2 weeks ago that is expired. But recommendation reason that my academic advisor wrote was not appropriate and that was "Keep studying Ph.D". I am planning to graduate my masters in August. And I-20 is expired on May/16.

Actually, I was notified that issue 5 working days before from ISS in my school that the reason is not appropriate and handed in a new recommendation form one day after when my I-20 expired.

At this case, do I need to follow applying procedure for a reinstatement with application fee $300?

I'm so depressed because I did everything that I could do to prevent this problem. But whenever I email to ISS of the school, the answer was that I should finish my masters within May/16 that is impossible for me. And Finally, they emailed me that I need to apply reinstatement now.
If there is some tips to resolve this issue that you can tell me, could you let me know?

Thanks for the response. So, technically, there is a window between when I transfer to Company-B and Company-B files my PERM, in which Company-A can withdraw/cancel my I-140. So, what happens to the status in that case? Will the Company-B H1(transferred) still be valid?

Hi All,
I have my EB2 485 pending (since July, 2007). I have EAD based on that filing. I am also on H1B - so I am not using EAD. But my wife intends to use EAD (based on our current EB2 based 485 filing) from coming August.

In the meanwhile I have got my EB1 140 approved. My question is if we file for 485 based on EB1 petition, do we lose our current EAD till a new EAD is issued under new filing? Are there ways to ensure that my wife continues with her employment and I move ahead with 485 filing?

Explore interfiling... no personal experience ... but the idea is that they use the same I-485 but interchange the underlying I-140. Seems like there is no special form for this but to just write to USCIS with evidence for the new approved EB1 I-140.

Here in my city (Piracicaba - S�o Paulo/Brazil) there is a river (Piracicaba�s River) that crosses the center of the city.

I was driving near when i saw something not commom, a man fishing and giving the fishes to this "gar�as" (i don�t know the name of this bird in english). There was more or less 8 to 10 gar�as waiting the fish.

Hi,
I posted the same information on FREE answers to questions from an Immigration Lawyer.

Here is my issue regarding the PD.

My Employer applied for labor through RIR under EB2 March6th 2004 which was then transffered to Philadelphia Backlog Center. Our Attorney suggested that we Apply through PERM process and Retain PD from the old case. Converted to PERM and applied on 09/26/2006 which was approved on 12/29/2006 but the letter said that they are not retaining PD from the old application as address is changed. Our employer moved 1 street accross in between these to application in Feb 2006. only street address changed everything including phone number remained same. My attorney said that he talked to the labor department in Chicago telling them that phone number didn't change. They said they will consider it and asked him to send a letter. It has been over 15 months he send the first letter. He said last month he also received a call from chicago office saying that they will take a look at the files.

In the meantime applied for I-140 and I-485 concurrently in July/Aug 2007. I-140 got approved on 05/28/2008 and got RFE for I-485 on 06/13/2008. responded to RFE and now case process resumed.

At this point I am trying to see if anyone have this kinda of issue and got resolved or there is away to get this resolved.

1. You can definitely change the employer and invoke AC21. No issues there..

2. You can change AOS to consular, but not after you've invoked AC21.
Actually there's probably a way to do that too , but maybe a good (and probably expensive) lawyer needs to be consulted.

Can I renew H1-B (12th year) after filed 485. Don�t want to use EAD in order to maintain my wife�s H4.

The AC21 document covers before I-485 filing stage. But not covering after 485 filed and retrogressed situation.

I have filed my I-485 during July 2007 as like many others. My PD is March 2004
Got married after the filing and still maintaining my H1 and brought my wife on H4.

I need to renew my H1 as it is getting expired in April. Not able to use EAD as need to maintain my wife�s H4.

This is my 12th year H1 renewal.

6 year 2005
1 year 2006
1 year 2007
3 year 2010


Question - Is H1-B extension rule applicable only for I140 approval/(labor 365 days) or is it allowed even after filing 485? And is it allowed after 11 years for additional 3 years?

In Ohio, they issue a DL for one year from the application for H1B extension if the H1B has not been approved yet. It might be the same case in NC as well - it might be worth checking.

Your husband could have answered this question with his 8th year extension in progress. But here it is, once you start working for a company on H1 and they file ur GC starting with LC and if the process is pending for a year then u get automatic extensions going forward. With PERM the LC is getting approved more faster and you should have it within the year. As for H1 to wait until oct 2007 that will be for new H1's if u were already on a h1 before you can convert to one anytime not waiting until oct2007. :)

Hello Mike,
I was about to launch Swift 3D and try what you were having problems with, but I found another solution that might work better. The best thing I would recommend that you try would be to use Flash for all the modification of the keyframes, etc.

I always use a separate Movie instance in Flash to import all my Swift 3D animations. Also, for the sake of file size, I only work on one Swift 3D animation at once. I then import that animation and any other animations to Flash itself. Within Flash, you can customize how many times you wish for the animation to loop, crop out extraneous frames, etc.

Try that method. Use Swift 3D for the initial 3D rendering and animation. Use Flash for the keyframe modifications, etc. Swift 3D has a very clunky keyframe interface, and it is not very user friendly.

Currently on H4 and validity expires on 09/23/2010. Can be applied for extension when principal applicants H1B is being extended(from his company), but since I have my H1B case filed with USCIS, will it create any conflict if I apply for H4 extension now? (ideally for 7 days (23rd sept to 30th sept) !! 'coz if approved, H1B status becomes valid from Oct 1st, right? )

Also, is there any rule which states that, when a case is pending with USCIS, legally you are not supposed to leave the country?

your question is that you are on h4 and have applied for H1. Your h4 will expire in sept.

If your h1b is approved, your h4 extension will be invalidated.... i think. check with the lawyer though
