A friend's H1B transfer from company A to company B was denied. Since his H1B with company A is still valid and is going to expire in 3 months, he can still go back to work for company A. However, if he chooses not to work for company A and tries to find a third employer to do another transfer, is he considered out of status for these three months?

I have a similar timeline - applied for LC in February 2002, got approval in December 2003, filed I-140 in February 2004, I-485 in March 2004. Currently filing for my fifth EAD! The USCIS not only tortures the whole family (it's a common practice that name check is pending only for primary applicant) but makes us to pay for the wait! My son was born around the time we filed for adjustment of status, he will go to school soon but we are still not sure whether we will be allowed to stay. We cannot plan ahead and open education funds for our children. My wife cannot go to college, as she is not eligible for in-state tuition discount. Needless to say, I am forced to sacrifice my career as the whole thing is dragging for 5+ years and I have to work at the same position to keep GC process alive. I've got MCSD certificate and outgrew my position long ago. I cannot quit my job and found a new business.

Change your Job. If the job description and responsibilities are same then you have a sure shot at AC21. Choosing a good job is really worth the little effort of filing AC21.

You cannot take a completely different responsibility job. I used AC21. The job has to have same responsiblities and designation can change. Salary can be little higher. I got 485 approved based on this AC21

Depends on when you sent your H1 renewal application. If you expect the approval by Jan, then you can wait as you can get at least 3 yrs of DL (p.s. - some states give DL beyond the visa expiry date)
Otherwise, use EAD to get DL for 2 yrs.

Here is some genuine feedback about USCIS customer service:
1. NCSC is unable to provide any inputs on the actual problem... this becomes a bottleneck.
2. Once an SR is created, no further SR can be created for 30 or 45 days...If you really got to know of an issue with your case from an SR that was first created, how and why is their this expectation that you need to wait for 30 days before which you can get back to USCIS for resolving that problem.
3. NO consistency in the answers provided by USCIS... I had an Infopass, call to NCSC and call to NSC within the span of one hour on the same day... The answers i got to the same question was completely different and completely off in some cases... How can candidates continue to wait and work patiently with USCIS if this continues?
4. Infopass appointment does not seem to help... I go and tell the officer about a problem and the officer says not a problem and just wait... the next time i talk to NSC, they tell me to follow up with an infopass.
Please highlight these points in the session in a constructive manner as a means to improve cusotmer service.

I did it in Ottawa. At that time we could get the visa stamped the same day in Ottawa. Now I think we need to wait for one more day (2 days in all). But make sure you read the Consulate website before proceeding. Different consulates have slightly different procedures.
You have to book the dates for the interview online. Once the date is booked, the Consulate will send you a confirmation letter. You can apply for a Canadian Visitor visa showing this letter.
The Consulate has given a list of required documents. Carry all of them. Also try to get all documents listed on the Chennai consulate too (they have listed more documents), that way you are safe.
Since Canada is almost like the United States, you wont feel that you have reached a strange land. You just feel like you are in another US city!

Hi, My mother lives in Haiti, i was not able to file a petition for her before the earthquake happened. Now with all of that going on, i need to know how to file and get her quicker to the us? Any response will be greatly appreciated, thank you
