hello, I am in a F1 status for about 3 years, I have been working and filing taxes. I am going to get married to a USC and apply for a green card through it. I want to know if I can have any problem in the aplication since I've been working without authorization.
Once you entered legally you should be able to get permanent residence even if you worked without authorization. as of now concentrate on 2 action items
- Sending Thankyou cards
- Upload IV video on utube
Thanks for saying that jonty_11. It seems most members do not want to do the things requested to us by the IV core team. We just want them to provide us "service" by working to answer our personal questions which we should be asking paid lawyers, we just want to logon to the website to get the latest news and think the IV core team is simply idiot to request us to send out Thank You cards and put YouTube videos. There is no scarcity or ranting on the forums about personal situations, patriotism, logic, economic arguments, and our our personal belief system whenever we find someone in conflict with us. However, most people do not want to function as a community and want others to prepare a list of amendments for them so that they do not have to do their homework, so that they could get their green cards sooner.
Guys, please do not post messages for the sake of posting messages. Each post takes away many man hours when thousands of people are reading the post. This is time spent away from important activity. Most members are simply posting new threads over and over again, asking the same question. I am not able to understand why do people not want to search for an answer to their question in the earlier posts. Why do we have to spend time in reading and answering same set of questions over and over again?

If yes then you should be fine but with or without original 797 and no stamping in passport it will be difficult to get into USA. Unless you have AP to get back into USA. Hope this help. Good luck for your travel tomorrow.

I just checked all immigration documents and found that original I797 (H1b approval) is missing. I have a copy but not original. We are travelling to India tomorrow. Is it must that we need to have original I797 at POE or is a copy ok. Appreciate if you could please let us know about this as soon as possible.

We are very busy these days trying to beat the H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) rush. While we fell that visas will not run out on April 1, 2010, clients are anxious to get their cases out the door. We promise to deliver.
Here are some tips that may help our last minute filers. The issue today is a degree that has not yet been awarded. In the past, the USCIS has approved H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html)for aliens seeking one of the 20,000 H-1B visas available to aliens who have earned master�s or higher degrees from U.S. institutions of higher education, where the alien has completed all requirements for the degree, and hence, has �earned� the degree, but the degree has not been conferred.
There is no reason to believe that USCIS will not continue that practice, so long as there is evidence that the alien has completed all requirements from an official at the educational institution qualified to provide that information. In the past, satisfactory evidence often was in the form of a letter from an official such as a Dean, Registrar, or department head, stating that all requirements have been satisfied and that the alien is simply waiting for the ceremonial conferral of the degree.
Be wary of letters prepared by unauthorized employees at the school stating that the student has completed all requirements toward a master�s degree, when in fact there are still examinations or papers to complete. USCIS is likely to question a letter that comes from a lower-level employee of the university. Be mindful also that use of such documentation when the student has not completed the program may be considered fraud. Also, use of such a document may result in the loss of the client�s chance at a slot in the U.S. master�s graduate quota since the petition likely would be denied on the basis of ineligibility at the time of filing.

I am posting this on behalf of my friend who is on H1 (6th year expiring in Dec, 2011). His labor is yet to be filed and in this connection we have a question. Process has been initiated by employer and tentatively labor will be filed in June, 2011. Hoping that he will be done with labor or I-140 by November would he be eligible for 7th year H1 extension?

Your receipt notice will show "receipt date" as July 3 - Oct 10 as Notice Date, thats when they entered your case into the system. If you end up with USCIS rep level 1, they say received date as Oct 10 as they don't have vicinity to Receipt Date. when I called to check the status of my AP, rep said, they receipted (noticed date) my case on 10/2 - it will take 3-6 months to get AP as TSC processing application entered on 7/17.
I got my receipt numbers by calling USCIS on Oct 12.

In my opinion - with a Apr10 AP expiry date, getting a Schengen until Apr20 may not be possible. Unless the consulate wants to be nice to you! :)

District 22: Nick Lampson (D) - District formerly held my Tom DeLay

My wife is US citizen and I am applying GC through her. We need to goto India for her sister's wedding on Aug 9th. How long does it take for AP to be approved? Can we expedite AP for wedding reason or should we do only for medical reason ? We live in California.

Do we need to get the passport renewed before it is expiring?
Just get it renewed while you are in US.
Its a one day affair to get your passport renewed(in person). You submit all your docs in the morning and pick it up in the evening.
