    Hi, I was hired 6 months ago as an Electrical Engineer and I am now preparing to apply for GC thru company Sponsorship. I have MS + 2 years and the position requires BS+7.

    1. Am I qualified for EB2?

    Dear fellow IVians/ Lawers.....

    Please help me

    I am on my H1B 6th Year Ending and my H1B valid till 2012 Sep 30 with my Current employer company A Which is a desi consultancy company.

    I have a approved I140 with company A. With PD of March 2008. I 140approved in OCT2008
    Cargability - India
    I485 - Not yet filed:o
    ----------------------------------------------------------
    on March 1st company A announced that they will be merging with company B.

    Company B Sent us an E-mail saying that they are acquiring resource group of company A.

    :confused::confused:

    When we questioned our old employer company A, they told us that yes company A will remain in existence but all human resources will move to company B :mad: All other assets and liabilities will stay with company A.

    I am in lots of confusion...and questions...heap of troubles it seems...
    Please tell me

    1. This Situation can be called/categorized as Aquisition/Merger?
    2. Will my I140 quilified for Successor of Interest if company B is ready to take over and sponcer GC for me?
    3. Or do I need to go thru the whole process of ADS, PERM, I140 path to come to current state?
    4. What happens if my PDate (Old, and assuming that in either case I can port my PD??) is current before company B's I 140 got approved? Can I file I 485 based on my company A I140 As company A still exists???
    Are there any complications involved in this?

    5. I am assuming that I am qualified to entitile 3 Year H1B visa with company B based on my company A approved I 140. am I correct?

    6. What happens if company A is going for bankruptcy before my H1B transfer?

    7. What happens if company A is going for bankruptcy before my I140 approved with company B and port I140 PD?

    8. also I heard that Company A may required to pay some amount to the employees(20K ??)? Any idea on this?

    Today i received my EAD card, It says fingerprint not available. I have not yet received FP notice

    Has this happened to anybody else, will i have to update EAD card after FP, how does this work

    Filed on July 16th, My checks were cashed on 10th Sep

    I planning to use AC 21 from Next week, I plan to call my parents in July 2008, What should I mention as my Immigration Status in Invitation letter.

    As I will not be on H1B and neither I have Green Card ?

    On Kodaks website they currently are offering a $1000 rebate on the 14N! Is this signalling the end of the 14N, certainly a full frame sensored camera has to cost more to produce than a 1.3 cropped 1D even though the canon is certainly a better Camera.

    My company filed an I-140 in December 2009. The petition (an EB2) was APPROVED in May 2010. A month or so later, I was laid off but BEFORE the I-485 was ever filed. As far as I know, the I-140 has not been revoked. What are my potential options here? Can I find a new employer to file a 485 provided the new job is similar to the I-140 petition or do they have to start the whole process again?

    Hi,

    I am presently working on L1B for company A. This year Company B applied for H1B and same is approved received the approved letter with I-94.

    Now I would like to continue in my current job with Company A till I find long project (Minimum 6 Months). My question here is can I continue in my current job after OCT 1st in my L1B Status.

    If I want to continue in L1B status what should I do? As of I heard if I travel out of the states and reentered in US after OCT2nd on L1B visa I can continue with L1B status. then what happens to my H1B status? Can I directly move to H1B status when I find a project from Company B?

    Please let me know how I should proceed to keep L1B and H1B status valid after OCT1st?

    To keep your L alive after Oct 1st, you should travel out of country before that date and return on L on or after the 1st.

    But now your H will no longer be valid. To activate it, you will have to go out, get a visa stamped and return using the new visa. Alternatively, you can also apply for a brand new H-1b as you have been counted against the cap. This new H-1b can be applied as a change of status from L.

    I recieved a letter from USCIS saying "we have forwarded your inquiry to Sec 245 Unit. You will be notified by mail at later date".

    What exactly this means?

    Do I need to worry about this Sec 245 Unit. Is it good or bad?

    btw I am on EB2 priority date Aug 2005 and still waiting for GC.......:mad:

    skarthy: Upgrade your H1 transfer to premium processing, get the transfer approved. Re-enter the country by showing your wife's old H1 stamping, get a new I-94 based on new approved H1 petition at POE. This is a easy route; If I were you, I will do this.

    So We are abandoning the current H1 if we go before its approved .
    How do I get the I-94 based on the new H1B , just ask them to stamp it like that ?

    having valid AP at any time, even though is not a legal requirement, is a necessity due to potential emergency travel to home country or any other country. Hence it is safe to reapply AP 2-3 months before expiry and EAD 3-4 months before expiry. This will give you peace of mind.

    So we need to choose local lawyers only? we don't have any options to Non-Local(Other State) lawyers?
    This is I am assuming you have given USCIS your NJ address, every Lawyer has to have License in the State he practices, if your CA Lawyer has a License to practice in NJ you can always call him to represent you. If this helps.

    I had the same issue. Because in my passport surname was missing ( not missing but it was added at the end of my first name) that triggered an FNU in H1 visa.
    But in my h1 petition it came out ok. and in I-94 i wrote my name correctly. so that was not an issue. and DL and SSN it came out OK based on I-94.

    i corrected it in my passport first. then during H1 visa renewal it got corrected automatically.

    even though you have FNU in visa, mention your name correctly in your I-94. otherwise every official document(SSN, DL etc.,) will have FNU as your first name. My friend suffered a lot
    because of this issue and he had to go back to india and come back with right I-94 and corrected the rest of the documents later.
