    I dont think so since someone is doing premium processing, the chances of getting RFE are more. Rather i read in other posts that we should go for Premium processing as it is faster and we come to know the result of the case quickly rather that awaiting for weeks/months.

    Hello Everyone,

    Here is my situation:

    1) My 6 years H1B with Company-A ends Sept 2011
    2) I-140 approved and my priority date is Aug 2006.
    3) Company-B(end client) offered a full-time position starting Jan 2010.

    What are my options? My questions are:
    1) Will I be eligible to extend my H1B with Company-B for another 3 years? Do I need a I-140 with Company-B to extend?
    2) Is it possible to use the labor and I-140, that I filed when I was with Company-A, to file for I-485? If I can, can I file the I-485 independent of Company-A? Do I need any kind of approval or paper work from Company-A?
    3) When Company-B sponsors my GC is it possible to port the priority date? Do I need to restart the whole GC process again with Company-B?

    I am really confused. Please help.

    (1) You can transfer your H1B for company B up to Sep 2011, but cannot extend it.
    (2) Assuming you have not filed your I-485, you can not use labor/I-140 of company A. A fresh Labor and I-140 will be required.
    (3) Priority date will be ported from your original application with company A

    I worked for company A as a full time employee from May 21st,07 to July 11th,08 and then company B filled my H1B transfer on June06th,08 and I joined company B on June 17th, 08 as a full time employee.

    So there is a overlap, I mean I worked for company A and Company B as a Full time employee from June 17th,08 - July 11th,08 and got full time salary from both of these companies.

    1. So will it be a issue, if companyB or some other company sponsers me a Green card in future?

    2. Can I use the experience letter issued by the CompanyA for Green Card purposes? If not then shall I mention to my attorney/Company who will sponser me Green card that I worked for companyA till June 16th,08 and there is no overlap.

    Frankly I don't know why people think that IT folks cannot qualify for EB2. Inspite of all changes done by DOL, people with 4yr degree + 5 years of exp. can qualify for EB2. If the company can make a good business case and can prove that there are other people (Permanent Residents/ Citizens) in the organization with 4yr degree + 5 years of exp. for same/ similar position, there should not be any issue for the getting an EB2 approved. As far as my knowledge goes, the requirements are set forth in law - that is not something that USCIS can change over night.

    True - it might become more difficult to get approval for such cases, but that does not mean that IT folks cannot qualify for EB2.

    Just my 2cents.

    1. You can definitely change the employer and invoke AC21. No issues there..

    2. You can change AOS to consular, but not after you've invoked AC21.
    Actually there's probably a way to do that too , but maybe a good (and probably expensive) lawyer needs to be consulted.

    I am currently on EAD and applied for I-485 in July 2007. My category is EB3 India.
    I am also maintaing my H1-B status with current company. My priority date is December 2005.

    As you all know about the situation of EB3 India and how long will it take to get to December 2005. I want to change the job as I am not getting paid as much as I am supposed to get considering my experience. I am also looking for some change and new opportunities.

    So my question is if I get a contract job through a staffing agency and will be working for another company on contract and may be I get permanent after few months or may be not. Is it possible to work on contract for a company through staffing agency using my EAD? I never worked on contract my entire career so don't know anything about it.
    What will I need to do or say when I go to staffing agency or the company I will be working for? what is the process?
    Please advice as I know many of you have done this or know all about it.

    Note: My wife is also on EAD( we applied for I-485 seperately) and not planning to move from the compay where she applied for GC.

    Hello guys,
    Need little advice from you guys.

    My wife is having her citizenship interview and oath ceremony on April 30th.
    My AOS Documents are almost ready and i am just waiting for her to become US Citizen. I just need her Naturalization certificate which i can attach with my I-130 application as proof of her citizenship.

    after she become citizen, should i wait for a week or 2, before i send my AOS application to USCIS or just send it right away.??? if i send my application on the same day she become citizen........does that gonna create any problem for my AOS case ???

    Wait until she gets certificate of citizenship. You can send it next day. Waiting one or two days does not make any difference.

    the change in salary ($76K to 120K) is a cause for concern. It depends how long ago you filed your labor. If it has been greater than 5 years, IMO the salary change may be ok. Rather than the titles, the job duties have to reasonably match.

    Dont you need the FP notice to even enter that building, the guard or the cop standing will not even let you in, if you dont have the FP call for notice.

    I never heard of walk-ins :)

    gcdreamer is right, you need FP notice. But if your question is if you miss your appointment date and then whether you can walk in another day, then answer is yes. I went to FP 2 weeks ago. A lady next to me, had FP notice dated 3 weeks earlier.The office let her get FP done.I personally did not do this.

    If the labor cert has been filed, approved and the I-140 has been filed, I think you can file for an extension of the H1-b. I was advised the same by my attorney, but by the time we filed for the extention, my I-140 was also approved (rather quickly).

    You should contact your immigration attorney right away.

    Hi
    My H1B expires on sept 30th 2010.(passport has vaild visa also stamped in it till sept 30th)
    Extension has been applied . If extension is approved say by august, can I go for stamping in august end.Basically how soon can i go for h1b stamping before old stamping expires.
    If there is a problem in stamping can i return on the old visa stamp.

    I have been to the interview before approximately 60 days of visa expiration 3 times and no issues.
    Last year when I went for interview I was told that my visa is approved and I will get the passport in 5-7 days but when I did not get the passport after 15 days I called embassy and was told that my case is in admin processing and will take up to 60 days. Since my previous visa was valid so I asked for my passport and got it and came on the old visa stamp.

    I came to US on H4, 3 years ago. Later I took my H1B with a recruiter and got it with I-94. It was valid up to 2007 oct. But I couldn't take up any work due to some problems. Recently I went to India and came back. At the port of entry I got new I-94 with H4 stamping. Means My H1 Is not valid now ? In this case, is there any way to apply for change of status again as my H1 is valid up to 2007. Or else do I need to apply for my new H1B again ? Pl. any one clarify.

    Once you are counted in the H1 cap you don't need to be counted again to extend your H1 status. But if you went to the consulate and got an H4 visa stamp, you might need to wait again till h1 visa is available again in april 2007.

    I am curious to know, how your interview went in the consulate. Because you were on H1, without working. If you were not working and not recieving paystubs you are out of status. Didn't that create problems when you change to H4 ?

    Those of you planning to reach the 485/EAD "heaven". Please have a look at this
    link suggesting you apply for EAD 6 months in advance.

    Apply too early and you are screwed by an early approval that will render your EAD valid for just 6 months(my last 2 were approved within 2 weeks). Apply too late and risk unauthorised work and or having to get fired/stay off the job.
    All this just weeks after they removed the ability to get an emergency 90 day EAD at the local field offices if they delayed more than 90 days.
    The USCIS is getting very mean with those of us waiting in the legal queue in my view. A lot is going on behind the scenes, I hope we are not all made scapegoats of dumb policy in the end.

    Does the bill have provisions to increase residency positions ? I heard few months back about hard lobbying to increase the match positions by 15000 to accomodate new patients because of the mandate. Any idea?

    I applied fro SSN replacement card like 2 weeks back. I havent recieved the card as yet, so i called SSN the lady on the phone said that two weeks will up tomm and should wait till the end of the week ,if i dont recieve the card by then i should check again. Any one else expereicned such a thing, i am getting worried since it is over weeks . I applied on Sept 17 ,called SSN on Sept 30 .
